NewWave (“NewWave” or “Company”) is committed to maintaining the principles of integrity and trust with respect to the privacy of personal data disclosed to NewWave. Collection of Information:
In connection with your application for employment and employment with NewWave, the Company may ask you to provide personal data, such as your name, mailing address, telephone number, e-mail address, birth date, and social security number. Additionally, NewWave may collect data relating to your education (e.g., schools and dates attended and degrees obtained), work history (e.g., names of former employers, dates of employment, and compensation information), military and veteran status, and criminal record. Once employed with NewWave, the Company may also maintain personal data concerning your employment with the Company, including, but not limited to, your job classification, compensation rate, work shift, hire date, and performance evaluations. In addition, NewWave may retain personal data relating to your health and medical information, such as emergency contact information, the name(s), birth date(s) and social security number(s) of your dependent(s).
Use and Disclosure of Information:
Your personal data will be disclosed only to employees of NewWave who reasonably need to receive such information to perform their duties. In certain circumstances, NewWave may be required to disclose your personal data in response to a valid legal process, pursuant to a request by a government agency, or under applicable law (e.g., when it receives a search warrant, subpoena, court order, or request from the Equal Opportunity Employment Commission). In such instances, NewWave will comply with the request. NewWave may also disclose your personal data in an emergency situation in which disclosure is necessary to protect the physical safety of an employee or where disclosure of your location or condition is made to your emergency contact or a government agency. In addition, NewWave may also disclose your personal data to third parties who administer NewWave’s compensation and benefit programs. With respect to protected health information (“PHI”) that NewWave maintains as the plan sponsor of your health insurance plan, the Company will comply with all privacy and security rules and regulations required by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). NewWave may also provide your job classification and dates of employment to potential employers, as well as to others authorized by you. In addition, NewWave may provide your compensation rate to potential employers and others, upon receiving written authorization from you to disclose such information. Finally, NewWave may transfer or disclose your personal data in connection with the sale of its business.
NewWave will not disclose personal data to any entity for marketing purposes and will not sell, rent, or license your personal data to others.
Security:
NewWave maintains commercially reasonable safeguards to ensure that the personal data you share with the Company is protected from unauthorized access or disclosure. The Company will ensure that its facilities remain locked during non-business hours, that file cabinets containing personal data are locked at all times, that computers on which personal data is stored contain password-control systems, that personal data transmitted over an electronic communications network is secure, and that only those NewWave employees who need access to personal data to perform their job responsibilities have such access.
Access to Information:
Personnel files, employment-related documents and personal information are accessible only to authorized individuals. Files and documents are accessible only to authorized employees from the Human Resources Department and the Office of the General Counsel, executives, managers and supervisors who have a valid, demonstrable business need for accessing said information. Access to personnel files, employment-related documents and personal information may be granted only by the Director of Human Resources.
Disposal of Information:
Any information obtained by NewWave from a consumer reporting company, in connection with establishing your eligibility for employment with NewWave, will be disposed of in accordance with the Fair and Accurate Credit Transactions Act of 2003, 16 C.F.R. § 682. As such NewWave will shred all papers containing consumer report information and will destroy or erase electronic files or media containing consumer report information so that the information cannot be read or reconstructed.
CONFIDENTIALITY OF CLIENT INFORMATION
Because the nature of NewWave’s business often involves disclosure by clients of confidential information to NewWave, the Company has implemented this Confidentiality Policy to limit disclosure of such confidential information.
All client-related information must be kept strictly confidential and should not be discussed with anyone who does not have a reasonable need to know such information, unless and until the client has authorized disclosure. Moreover, such client-related information should not be discussed with non-NewWave employees without the permission of the client. The prohibition against revealing confidential client information applies both during and after an employee’s employment with NewWave. NewWave reserves the right to terminate the employment of any employee who fails to comply with this policy.
All documents containing confidential client-related information of any kind that are not maintained in accordance with NewWave’s record keeping practices must be shredded before they are thrown away.
